In the name of GOD Amen.
KNOW ALL MEN, that I, John Conger, Sr., of the county and state aforesaid,
being of perfect mind and memory, yet knowing that it is appointed for men once to die, and knowing when it shall please GOD to call me hence, that I be no more; do find it necessary for divers good causes to me occuring, to constitute and confirm this my last will and testament.

First of all, at my decease, I bequeath my soul to GOD who gave it, as the receiver of SPIRITS, which though faith, I hope to be united with my body, at the general resurrection, and received into GLORY in the heavens.

There are three Conger graveyards on these lands [where the family lived in Rowan/Davidson county, NC]. Two are on Abbott's Creek. The one which is on the original lands owned by John Conger is on the right side of Abbott's Creek, one mile north of the Yadkin River. In it is buried Zipporah Conger, beside what is supposed to be the grave of John Conger. (CFA I, p. 283)

At a town meeting, held at Woodbridge, [NJ] on 11 Mar 1760, it was voted that Jonathan Conger, John Blanshear and Thomas Bronson shall be overseers of the poor.

In the name of God, amen, 2nd day of March, in the year of our Lord Christ, One thousand seven hundred and seventy nine, 1779.

I, Jonathan Conger of Woodbridge, in the county of Middlesex and State of New Jersey, being very sick and weak in body but of perfect mind and memory, Thanks be given to God, therefore calling unto mind the Mortality of my body and knowing that it is appointed for all Men once to die, do make and ordain this my last will and Testament that is to say principally and first of all, I give and recommend my Soul into the hands of God that gave it, and for my body I recommend it to the Earth to be buried in a Christian like and decent manner at the discretion of my executors, nothing doubting, but at general Resurrection I shall receive the same by the mighty power of God, and as touching such wordly estate wherewith it hath pleased God, to bless me in this life, I give, devise and dispose of the same in the following manner and form.

And further my will and pleasure is that my beloved wife, Ann Conger, shall be comfortably supported with every necessity of life by my aforesaid two sons, equally alike in the expense, and lastly I constitute, make and ordain my well beloved son John Conger, and my treasured friend James Manning, as my only and sole executors of this my last will and testament, and I do hereby utterly dis-allow, revoke and dis-annull all and every other former testaments, wills, legacies, and executors by me in any ways before this time named. The will of John Conger of Hanover Township, [Morris Co., NJ], "indisposed," was dated 14 Feb 1767, and proved 22 Dec 1767.

To his wife, Sarah, he left 50 pounds, and the use of all his real and personal estate for a period of five years. At the end of that time his land was to be divided between his sons Joseph and John.

To sons Stephen, Zensa, Thomas, David and James, he left each 30 pounds to be paid as they became of age, and in the case of any of them dying before reaching the age of 21, his share to be divided among the others.

To his daughters, Sarah and Phoebe, he left 15 pounds, to be paid at marriage or on reaching the age of 21, payments to be made by sons Joseph and John.

As executores he named "My friend and brother, Thomas Brown, and my friend, Joseph Tuttle, Jr.:

COMMENT-CHILDREN: On page 158 of CFA I, the family of Enoch Conger is listed. His son, Moses Conger, born, Abt. 1770 in Dutchess Co., NY is not listed. He is, however, listed, with his own family, on page 379 of CFA I. Son, Coddington Conger, is also not listed on page 158. A daughter, Ruth, is listed in his will but not listed as a child in CFA I, p. 158.


RECOLLECTIONS:
Enoch Conger, son of Job and Keziah Conger, was named as executor of his father's will, and also inherited one-half of all his father's real estate. The will was dated 29 Jan 1749, but was not proved until 17 Feb 1758, at which time it is thought the youngest son, Moses, became of age. The will provided that Enoch was to have the use of the inheritance of his brother, Moses, for a period of seven years. The will further provided that neither Enoch or Moses could dispose of their inheritance until they had attained the age of thirty years.

It is thought Enoch Conger left Rahway [NJ] about 1765, or later, and removed to Nine Partners, town of Northeast, Dutchess County, New York, a place only a short distance from New Fairfield, Conn, where his cousin, Joseph Conger, was then living. From there he moved to Danby, VT before 1770.

From Wiliams's "History and Map of Danby, Vt," we gather the following abstract of the settlement and organization of the town. Sixty-eight persons petitioned to the governor of the Province of New Hampshire for a grant of land six miles square. On 27 Aug 1761, the petition was granted. Enoch Conger was not one of the petitioners.

Each one of the petitioners was to have an equal share and their share, or lot, was to be numbered. The company had their headquarters at Nine Partner's, Dutchess County, New York, where the drawing took place on 5 Sep 1763. Among the first settlers who came in 1765 was Joseph Earl. The annual meeting of the proprietors was held in 1766, 1767 and 1768 at Nine Partners, and after that at Danby, [VT].

The organization of the town of Danby, VT, dated from 1769, and in that year the first highways were laid out, and the second division of land was made. The first road laid out was on the land of Joseph Earl. Quite a number of the original proprietors were selling their rights to new settlers. The trouble over the "New Hampshire grants" was on, and was causing a great deal of disturbance. New Hampshire, the Province that made the grants, was exercising authority over them and this authority was disputed by the Province of New York. Hence the reading of the body of the deed, next to be mentioned.

These deed records are taken from the Danby Town Records. As Williams makes no mention of Enoch Conger. A deed dated 23 Mar 1771 and recorded 29 Apr 1775, Joseph Earl to Enoch Conger, "all undivided lands after the third division, belonging to the first division right of lot number 35". This was originally owned by William Barton, and lot number 47 by William Shaw, both of whom sold to Joseph Earl.

On 20 May 1772 Enoch Conger recorded his ear mark, which is a slit in the top of each ear of livestock. The next reference to Enoch Conger is dated 6 June 1776: "then surveyed and laid out for Enoch Conger, one fifty acre lot of land, laying on the west side of Micha Vail's third division lot. The above fifty acres belong to the right number 35, in the first division of land in said township.

Whereas I Enoch Conger of Danby, in the county of Charlotee, and state of New York, being low and weak in body, but in my right mind, and perfect memory, than[k] God, do make this, and ordain the same to be my last will and testament as follows:

First of all, I will and bequeath to my dear and well beloved wife Berzillah, all that 50 acres of land wherein she now lives, as long as she remains my widow, to have the whole of the profits thereform, arising and further, that my said widow keep her family together, as much as in her power, and convert the profits of said farm to the use of bringing up my poor orphan children until the youngest shall become to the years of maturity, or to the age of twenty and one.

Further, I do hereby constitute and appoint my two sons, Job and Enoch, after my decease, to pay all of my funeral charges, cost of doctors and nurses, and all other necessary charges accrued in this my sickness, out of such part of my estate as can be spared, out of my family so left, and further, if my said widow shall think most convenient for herself to marry after my decease, in any time before my youngest son shall be of age, that I hereby order my two sons here made executors to take all my estate both real and personal, and forthwite have the same inventoried, and appraised according to law, and give to their mother her third. And then divide all the rest, and remainder of my estate equally with all their brothers, and making their sister Ruth equal with any of her brothers, always reserving to themselves, over and above any of the rest, sufficient to pay all my just debts. And this I make and ordain to be my last will and testament, according to the true intent and meaning, herein set forth.

EMIGRATION: Moses Conger remained in Woodbridge until 1771 when he offered his land for sale. CFA I, p. 275.


PROBATE: Moses Conger inherited, through the will of his father, one half of the estate, and his brother, Enoch, inherited the other half, but was to have the use of one half of the Salt Marsh willed to Moses, for a term of seven years father the death of his father, Job, which might indicate that Moses Conger was but 14 years of age at the dating of his father's will in 1749, and that it would be seven years before he would attain his full right at the age of 21, which would be in 1765 -- thereby indicating the year of his birth to be about 1735.

Both were forbidden to dispose of their inheritance until they had reached the age of 30 years, which in the case of Moses would be about 1765. He was known to have been living upon his estate in Rahway, NJ as late as 1771.

RESIDENCES: The two older brothers of Moses Conger, Job Jr., and Enoch, removed to Dutchess county, New York and later Job removed to Albany county, New York and Enoch to Danby, Vermont, about 1770. Moses apparently remained in Middlesex county, New Jersey.

LAND:
On 18 Feb 1771, the following notice appeared in the "Weekly Post Boy," #1498: "Notice is hereby given that the plantation of Moses Conger is to be sold by a public sale to the highest bidder at vendue, on the 25th day of March in the afternoon, if not sold at a private sale before.

"It is well situated for a gentleman, a tradesman or farmer, allowed good land lying in Woodbridge, Rahway Neck, adjoining that pleasant river which afford[s] fish in plenty in season, and is navigable for boats, sloops, etc.. There is a tolerable good house and barn. It is exceedingly well watered, some wood and fine orchard, and another one which is considerably older. It contains by estimation between 70 and 80 acres of upland, nearly 15 acres of Salt Marsh, as handy and as good as any in that part. Any person wanting such may apply to the subscriber before the day of the sale, who will give good title, and reasonable terms N.B., said place likes convenient for a ferry to be erected across the Rahway River to Elizabethtown. It is not known if this was his own land he was selling, or the land of his nephew, Jonathan Coddington, of whose will he was an executor. However, the Salt Marsh is mentioned, so this may have been his land.

LEGAL_MATTER:
The next, and last, mention we have concerning Moses Conger is that in the April term of court in 1771, John Watson sued Moses Conger, and at the July term of the same year Abraham Shotwell sued Moses Conger. No particulars are given in the Middlesex county Court Records.

EMIGRATION:
It has been noted that until 1771 the name of Moses Conger was mentioned quite frequently in the Middlesex county, [NJ] county court records. After that date, there is no further mention of him in any source in New Jersey. Judging from the number of lawsuits in which he was involved, it is surmiesed that he removed from New Jersey to Kentucky [no source citation], and later on went to what is now Cincinnati, Ohio. He may have removed, with his family, to Kentucky between 1785 and 1790.

RECOLLECTIONS: According to a letter from Dr. Mount Johnson of Venango, Crawford county, Penn., dated 2 Feb 1911:
"As the tradition went, Moses Conger and a relative unknown, left New Jersey and started west. Moses Conger had his leg broken somewhere in the mountains, between New Jersey and Wheeling, West Virginia [sic, Virginia]. Whether the relative deserted him or was killed by the Indians, Moses never knew.

"He was taken in by a Quaker family, where he remained about a year, and then floated down the Ohio River to some place in Kentucky. Of his subsequent career, nothing is known until he went with other volunteeers called for by Governor Isaac Sheel, to go to Fort Washington (now Cincinnati) and from there with 'Mad' Anthony Wayne, to the balled of Fallen Timbers in August 1794.

"On his return he was favorably impressed with the lands in Mill Creek Valley in Hamilton County, Ohio, and tried to buy a quarter section of land, but did not have money enough. However, in the spring of 1795 he removed from Kentucky to Ohio, and squatted on some land there, and worked for the Ludlow family, at or near Cincinnati.

"In 1798, his wife died and was buried where not stands the First Presbyterian Church, near the corner of 4th and Main Streets. About 1841, the bodies were removed from this burial ground, and in the removal of bodies, the charts and files were lost.

"In 1804, Moses Conger removed to the Bray place near Westwood, as it is now called.

"In 1809, he died west of the great Miami River, near the present town of Harrison, Ohio, practically on the Indiana line (of milk sickness)."

Dr. Johnson referred to his great uncle, Daniel, so his grandmother must have been Ara Conger, who married John Banos. His mother died of Asiatic Cholera on 12 Jul 1850 and was buried in Banos Graveyard. She was born in 1813 and married in 1834.
[Note: Mrs. Leonard is confused about the relationship of Dr. Mount Johnson. His mother, Ara Conger, married Henry Johnson. His grandparents were: John Hendricks Conger and Nancy Grady and his great grandparents were Moses Conger and Miss Hendricks. This conclusion reached based on where Ara Conger's brother, Daniel McFarlane Conger, fits in the family tree. REH]

He mentioned visting the widow of his mother's [note listed in CFA I, p. 378, as g/mother's] brother, Daniel McFarlane Conger, living at Peoria, Illinois and his mother's only sister, Caroline Conger Wallace, who was buried in Lincoln, Ill. When the above letter was weitten from Nashville, Tenn. Dr. Johnson was 76 years of age.

LEGAL_MATTER: Enoch Conger advertised in the New Jersey Gazette on 9 Sep 1778 that a strange bay mare had broken into his pasture in Morristown in June previous and requested the owner to come and take it away.

PROBATE: The will of Enoch Conger (N.J. Wills Liber 39, p. 478) is dated at Morris Township, Morris County, New Jersey, 9 Apr 1801 and was proved 21 Dec of the same year, a few days after his death.

To wife Susanah he left the usual one third of his moveable property and the use of one third of his real estate for the remainder of her life.

To son David he left the homestead farm, 90 acres and 5 1/2 acres in the great swamp, which was bought from Aaron Goble.

To son Enoch he left 7 pounds, the young man having had his share.

To daughter Nancy he left 100 pounds.

To daughter Theodosia Fairchild he left 30 pounds.
